Gift Card Agreement and Terms of Use

The "Biletix Ticketmaster Turkey Gift Card Usage Agreement", the provisions of which are written below, regulates the necessary rules regarding the use of the Biletix Ticketmaster Turkey Gift Card, and this agreement must be accepted in order to use the gift card. In this context, within 14 days from the date of purchase of your gift card for digital purchases, and within 7 days from the date of purchase of your gift card for physical purchases, by not making any objection to the contact number 0850 755 55 55 or not exercising your right of withdrawal within this period and/or by using your gift card before this period expires, you can sign this Agreement electronically within the meaning of Article 9/A-2 of the Law on Consumer Protection. We emphasize that you will be deemed to have accepted, declared and undertaken that you have confirmed, that this contract is valid between the parties, that it regulates the relations between the parties, and that you are bound by the provisions of the contract and contractual obligations.

Biletix Ticketmaster Turkey Gift Card Usage Agreement

This Biletix Ticketmaster Turkey Gift Card Usage Agreement ("Agreement") is the agreement between Biletix Ticket Basım Dağıtım A.Ş., the creator of the Biletix Ticketmaster Turkey Gift Card ("Gift Card and/or Card") and the owner of all intellectual and industrial property rights and other rights of this card. It is valid between ("Biletix") and the persons using this card ("card users"), determines the terms and conditions of using the card and regulates the relations between the parties.

1. Acceptance

• By using the gift card, the gift card user accepts, declares and undertakes to comply with all the terms and conditions in the contract. The "Terms of Use" and "Biletix Sales Policy" specified on Biletix's website will apply in all cases such as "ticket refund-cancellation-loss-stolen", "postponement of the event" and all other cases after the gift card is used and the "event ticket" is given to the card holder. Therefore, by using their cards, gift card users declare and undertake that they have read, understood and accepted the "Biletix Sales Policy", "Biletix Privacy Statement" and "Biletix Terms of Use" available on https://www.biletix.com/ourpolicies/TURKIYE/tr.
• In the event that the gift card is used by third parties with or against the will of the card user, the third parties using the card will also be subject to all the terms and conditions in this Agreement.

2. About Gift Card

Biletix gift cards are cards issued by Biletix. There is no upper and lower loading limit for bulk Gift cards purchased corporately. The amount of TL to be loaded on Biletix Gift Cards can be in the form of amounts determined by Biletix.

• The card contains a monetary value that has already been paid on the purchase platform. Gift cards are not a credit card, charge card, check, guarantee card, or debit card, and the gift card balance will not earn any interest. Gift Card fees cannot be paid with another Gift Card.
• Gift cards are valid for 12 months from the date of activation. If the card amount is not used partially or completely within this period, the card balance will become unusable and the amount in the card will not be refunded, refunded or exchanged.
• Provided that the card is not used, the card can be returned within the objection period of 14 (fourteen) days from the date of purchase of the card for digital purchases, and within 7 days for physical purchases by objecting to the provisions of the Agreement and/or without giving any reason. In this context, Biletix; "The card buyer has the right to withdraw from the contract by returning the card within seven and/or fourteen days from the date of receipt of the card, without assuming any legal or criminal liability and without giving any reason, and to receive the card back as of the date the withdrawal notification is received by Biletix within the scope of the relevant provisions of the Agreement". On the other hand, after the expiry of this period, it will not be possible to return or cancel the gift card or request the balance on the card, except in the case of the card being faulty/defective/damaged and for other reasons stipulated in the provisions of the legislation. In the case of card refunds and cancellations that can be made within the framework of the provisions of this Agreement, the refund of the amount on the card will only be made to the purchaser of the card, subject to the presentation of the receipt issued at the time of purchase of the card.
• Gift cards do not have a cash redemption value and cannot be exchanged for cash or given in any portion of the value loaded on the card at the time of purchase. Gift cards cannot be redeemed for cash and/or cannot be requested to be redeemed for cash.
• It is not possible to exchange a gift card for a different class or type of gift card, or to combine the unused value of two or more cards on a new gift card.
• When the monetary value loaded at the time of purchasing the gift card is used, the card will not be reloaded. In other words, the card can only be loaded at once and at once. On the other hand, it is possible to use the balance in the card in proportion to the balance amount and/or to use it with the partial payment method (Partial Payment: When purchasing a product, the total amount is divided and paid with more than one payment instrument).
• Gift cards will not be reprinted or produced, except if the card is faulty or damaged as a result of the production process and/or damaged due to Biletix or participating retailers and their employees.
• The Gift Card invoice will be sent to the e-mail address provided by the Gift Card purchaser.
• For the purposes of ensuring transaction security, preventing malicious and/or irregular transactions, and serving the legitimate interests of Biletix as the data controller, it is mandatory that all transactions made via the Biletix website using a gift card be carried out under a registered Biletix membership account. In this context, gift card users acknowledge, declare, and undertake, with their informed consent, that in order to carry out any transaction using a gift card and/or to purchase tickets/products-services as defined under this Agreement, it is necessary to create a Biletix membership account, and that users without a membership account will not be able to make any transactions and/or payments using their gift cards, and that they have been informed of this requirement prior to purchasing their gift cards. Therefore, we recommend that users who do not wish to create a membership account consider this pre-information before purchasing a gift card, and visit our Help page and/or contact us via the communication numbers provided on our website before making any gift card purchases or confirming their orders.

3. What Can Be Purchased With a Gift Card?

• Gift cards can only be used to purchase tickets for participation in selected events related to Biletix/ Ticketmaster in Turkey and/or to purchase Biletix products and services ("Biletix/Ticketmaster Products"). The Gift Card is not valid for football match tickets. The Gift Card can only be used for designated events.
• Gift cards cannot be used to purchase any goods or services other than Biletix/Ticketmaster Products.
• Gift cards cannot be used to purchase tickets to events taking place outside of Turkey.
• No change will be given for purchases made with a gift card, but all unspent portion of the value loaded onto the card at the time of purchase ("card balance") will remain available for use in accordance with the terms and conditions in the Agreement.
• Although a user may purchase more than one Gift Card, more than one Gift Card cannot be used for the same event ticket.

4. Where Can Gift Cards Be Used?

• Gift cards, whether in the form of digital or printed physical cards, can be used on the Biletix website with www.biletix.com extension and/or at Biletix Retail Outlets within the scope of the provisions specified in Article 3.
• Gift cards cannot be used on sites other than the www.biletix.com extension internet address, even if there are websites that redirect to or refer to the www.biletix.com address.
• Gift cards cannot be used to purchase tickets from the organizer's main sales counters located at the event venue.
• Gift cards can be used to make purchases up to the value charged on the card at the time of purchase. On the other hand, a payment for Biletix products can be made partly by gift card and partly by using other accepted payment methods (e.g., credit card). In other words, it is possible to use gift cards alone, or it is possible to use cards by adding to the value of the card via cash or credit card. On the other hand, the purchase/usage amount or the ticket price of the selected event; If the price of the gift card is less than the price, the remaining amount will remain in the card, and it will not be possible to refund money from Biletix or other interested parties and claim any rights and receivables in this context. If gift cards are used for online transactions, the security number must be known, as the 3-digit security number written on the back of the card is required to complete the transaction. You agree that if Biletix products are purchased through the use of gift cards, the value of your card may decrease in proportion to the value of the Biletix products. The card user knows and accepts that he/she is obliged to provide the information of the gift card he/she owns, enter the 3-digit security number on the gift card into the system, and share it with the authorized persons at the points of sale, if necessary, depending on the method of purchasing Biletix products (online, face-to-face, etc.).
• When the card user authorizes a transaction to purchase Biletix products, he/she agrees to pay the purchase price of the Biletix product(s) he/she has purchased, as well as to pay the purchase price by decreasing the value loaded on the gift card on the date of purchase.
• The card user, gift card; accepts and undertakes that he/she will use it in accordance with the terms and conditions specified in the terms and conditions of the event or the conditions for the purchase of Biletix products, otherwise he/she will be responsible for this. In this context, for example, if persons under the age of 18 are not allowed to participate in certain events or purchase certain Biletix Products, and the card user under the age of 18 has purchased these products without complying with the age limit, the fact that he has made the "purchase" will not mean that he will be able to purchase the products or participate in the events, and therefore all responsibility and risk will belong to the card user.

5. Consumer Rights

• Card users have the right to cancel their card purchases and get a full refund of the amount they paid to the card within 14 (fourteen) days from the date of purchase of the card for digital purchases and within 7 days for physical purchases, provided that they do not use their gift cards and do not make any transactions with their cards, and depending on the receipt presented at the time of purchase of the card. In this case, all delivery costs related to the return of the card will be borne by the card user.
• In order for gift cards to be canceled within the scope of this article, it is necessary to call 0850 755 55 55, and in the meantime, it is obligatory to share the receipt information issued at the time of purchase of the card.

6. Expiration of the Card

• Gift cards are valid for a period of 12 months from the date of activation of the card, during which period they are valid for a period of 4. It can be used for the purchase of Biletix/Ticketmaster products within the framework of the provisions of the article. After 12 months have elapsed from the date of activation of the card, it will not be possible to reuse the card or refund the remaining balance in the card, even if all or part of the value loaded at the time of purchase remains on the card.
• After 12 months have elapsed from the date of activation of the card, all unused values, if any, remaining in the card will be forfeited and will be invalid. In this context, the cardholder accepts, declares and undertakes that he/she will not make any claims, claims of rights or receivables or any other objection or demand against Biletix or other interested parties for this reason.

7. Checking Card Balance

• It is possible to check the amount of unused money on the gift card by calling 0850 755 55 55 or by entering the link with the extension biletix.com/hediyekart.

8. Card Security

• Gift cards are issued in bearer form and there is no name on the card. Therefore, please do not lose your gift cards and keep them well. Otherwise, Biletix and other relevant parties are not responsible in any way for the use of lost or stolen gift cards, consumption/consumption of the balance in the card and/or loss of money. Gift cards are in the form of cash, and in case of loss of gift cards, the card will not be replaced, and all unused amount remaining in the card will be lost, such as the loss of a wallet.
• The gift card number and three-digit security number must be kept confidential at all times and must not be disclosed to anyone other than authorized persons.

9. Cancellation of Card by Biletix

• Biletix; If it suspects that a gift card is being used fraudulently, without permission or illegally, or within the scope of other justified reasons, it has the right to unilaterally terminate this Agreement with the card user without justification, to cancel the card and to refuse/not accept the transactions made/intended to be made with the card. In this case, the remaining amount in the card will not be returned to the card user. The cardholder accepts, declares and undertakes that he/she will not make any claims, claims of rights or receivables or any other objection against Biletix or other relevant persons due to cancellation or termination within the scope of this article.
• In the event that a transaction made/intended to be made with the card needs to be investigated for any reason, gift card holders have agreed in advance to cooperate with Biletix or other authorized judicial/administrative authorities.
• 9.1. Except for the reasons stated in the article, Biletix has the right to unilaterally terminate this Agreement and cancel gift cards at any time, without any obligation to give any reason, provided that it notifies card users in writing at the latest 30 days in advance. A termination to be made within this scope is a collective termination covering all card users, in which case all unused funds in the card will be returned to the cardholders and the gift cards will remain the property of Biletix. The relevant provisions of the Agreement for cases where the card balance will not be refunded are separate and reserved.

10. Personal Data

All personal data provided in connection with the gift card will be handled in accordance with the "Biletix Sales Policy", "Biletix Privacy Statement" and "Biletix Terms of Use" available at https://www.biletix.com/ourpolicies/TURKIYE/tr  and will be processed in accordance with these provisions.

11. Limitation of Liability

• Except for reasons that may require the responsibility of Biletix or its employees, gift card holders are directly responsible for the use and storage of their gift cards and all transactions in which the card is used. When cardholders lose their cards, their cards are stolen, or they suspect that their cards have been used for an unauthorized transaction, they should immediately report this situation to the Biletix Call Center number 0850 755 55 55.
• Biletix does not accept any responsibility for lost, stolen, destroyed or unauthorized cards, except for reasons that require responsibility for Biletix or its employees.
• Biletix shall not be liable for any loss of business, loss of use, loss of profit, loss of contract, loss of revenue, or loss of estimated savings within the scope of loading or using gift cards; loss of data or use of data; or special or consequential loss or damage.
• Biletix shall not be liable for any loss or damage arising from any event which cannot be reasonably controlled or avoided, nor shall it be liable for any failure to perform any of its obligations with respect to the card under these terms and conditions. These events include natural disasters, mass epidemics/diseases, pandemic processes, acts or omissions of states or their institutions, strikes or other industrial-technological events, fire, flooding, storm, riot, power failure or malfunctions or war or other acts and omissions of third parties and all events/phenomena of force majeure in the nature of similar content.
• Without prejudice to the special provisions of this Agreement, Biletix does not bear any responsibility within the framework of this Agreement, except for the obligation to return the remaining balance in the card to the card buyer. Therefore, subject to the terms and conditions of this Agreement, in the event that the Agreement is terminated and/or the card is canceled by Biletix or the card user, only the balance amount in the card will be returned to the card buyer and Biletix will not have any other responsibility. The relevant provisions of the Agreement for cases where the card balance will not be refunded are separate and reserved.
• When a Gift Card is purchased, the Gift Card in question is not allowed for reasons beyond Biletix's control, including inadequacies or malfunctions of telecommunication lines/systems or delays in the transmission of data, incorrect details of the recipient of the Card issued by the Gift Card purchaser, or failure to deliver the Gift Card to the specified e-mail address and/or the e-mail sent by Biletix is seen as spam or unsolicited e-mail. Biletix will not be responsible for the failure to receive or delayed receipt by the buyer

12. Changes

Biletix may terminate the terms and conditions of this Agreement at any time in the event of one or more of the following reasons. https://www.biletix.com/hediyekart  can change unilaterally by announcing it in the link with the  extension:

• Initiation or development of new systems, methods of activity, services or facilities (including, but not limited to, adding or removing goods or services from the system that can be purchased with the Card),
• reflect a change or expected change in market conditions, general good practices, or the cost of providing services to customers;
• Any situation that may be deemed necessary by Biletix,
• To adapt to changing legislative regulations.

13. General Provisions

• Delay or non-exercise by Biletix in the exercise of any right or authority under this Agreement shall not be construed as a waiver of such right or authority or prevent the exercise of such right or authority at any later time.
• If any provision of this Agreement is held to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
• Biletix reserves the right to assign its rights and receivables arising from the Agreement at any time without prior written notice. Biletix also has the authority to transfer any of its obligations under this Agreement to subcontractors or other third parties.
• A third party that is not a party to this Agreement has no right to exercise/exercise any rights of this Agreement. Insofar as gift card holders/users who have not purchased the card are subject to the provisions of the contract and Biletix policies, it is separate and reserved.
• This Agreement and any dispute arising out of the Agreement (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Turkey. In the event that any dispute arises due to this Agreement and/or gift card purchases, it is our main goal to try to resolve the dispute amicably first. On the other hand, in cases that cannot be resolved amicably, we would like you to know that you, the consumers who purchase gift cards, can take their possible problems to the consumer arbitration committee within the framework of the monetary limits published in the relevant legislation or to the consumer court, provided that a mediator is consulted before filing a lawsuit pursuant to Article 73/A of the Law on Consumer Protection. Regarding any claim or matter arising out of or in connection with this Agreement, Istanbul (Çağlayan) Courts and/or the Courts and Enforcement Offices in the place of residence of the consumer are deemed to be authorized.
